What should I do if I am in accident with an uninsured driver?
Treat the accident just as you would any other accident.
First, make sure that nobody is injured. If a police officer is not present, use an available cell phone to notify them of your accident, providing details about your location and any injuries.
While waiting for the police to arrive, begin exchanging information
with the other drivers. Typically this includes sharing driver license
numbers, license plate numbers, contact information and insurance cards.
If you have a camera available, take pictures of the accident scene. Even
if you believe that you caused the accident, never admit to any
fault.
If one of the other drivers is uninsured or offers you an expired proof
of insurance card, it is very important for a police officer to be
involved at the scene. Most states require drivers to carry proof of
insurance, and uninsured drivers face fines and even driving suspensions
when caught.
If the uninsured driver attempts to leave before police arrive, be sure
to at least get the driver’s make/model of car and license plate. If
there are witnesses who cannot wait for the police to arrive, ask for
their names and phone numbers, too.
