  • Returned check fee: The lesser of $25 or the maximum allowed by applicable state law per returned check
  • Fixed Interest Rate Credit Advance Breakage Fee: The greater of: (i) the sum of (A) the present value of the scheduled Monthly Payments on the Credit Advance from the date of prepayment to the expiration of term and (B) the present value of the amount of principal and interest due on the expiration of term of the Credit Advance minus (C) the outstanding principal balance of the Credit Advance as of the date of prepayment; or (ii) $0.00. The present values described in (A) and (B) are to be computed on a monthly basis as of the date of prepayment, discounted at the yield to maturity of the U.S. Treasury Bill or Note that is closest in maturity to the expiration of term of the Credit Advance as reported by The Wall Street Journal or another comparable financial market resource designated by Nationwide. Notwithstanding the foregoing, commencing on the Monthly Payment date that is one month prior to the end of the fixed interest rate Credit Advance term, Borrower may prepay the full outstanding principal balance of the Loan fixed interest rate Credit Advance without any breakage fee. This term is not applicable to Borrowers residing in the states of Alabama, Delaware, Idaho, Iowa, Maryland, Minnesota, Montana, Vermont, and Washington.
